Who permits concrete contractors in Cypress Gardens?
Every one of the 4,003 Property Appraiser parcels that sit wholly inside the Cypress Gardens census boundary lists WINTER HAVEN as its city. Yet all 106 points we sampled across the CDP fall outside every city on Polk County's city-limits map. So the permit office is the county's Building Division in Bartow, not the City of Winter Haven's Building & Permitting Division.
The exception is right next door. LEGOLAND Florida, built on the old Cypress Gardens attraction grounds on Lake Eloise, sits inside Winter Haven city limits. The lots across the road from the park are county.
| Where the property is | Permit office | Flood rule for a new building's lowest floor |
|---|---|---|
| House lots in Cypress Gardens (Winter Haven mailing address) | Polk County Building Division | At least 1 ft above base flood elevation (Polk LDC Sec. 630) |
| LEGOLAND site and other parcels inside Winter Haven city limits | City of Winter Haven Building & Permitting | Base flood elevation plus 2 ft (city Sec. 5-23) |
| Lots on the Lake Eloise shoreline | Check the parcel on the county's city-limits layer | Depends on which side of the line the parcel falls |
We can check your parcel before we price the job. If the county turns out to be the office, every step after that, from the permit to the inspection, runs through Bartow and the county's online permit system.
Which Cypress Gardens concrete jobs need a Polk County permit?
Polk County's permitting page says these concrete and hardscape items need a construction permit:
- Concrete slabs next to a house or accessory building, slabs meant to support a structure, and raised slabs
- Sidewalks, and any part of a driveway that sits in the road right-of-way or inside the minimum setbacks
- Pavers inside the required setbacks or against a structure
- Decks, walkways, platforms, stairs and landings, which have to meet setbacks and stay out of easements
- Structural and decorative retaining walls
The county's notes also say slabs must meet setbacks from property lines and easements (sidewalks and driveways excepted) and Building Code and Land Development Code drainage requirements. Florida's newer under-$7,500 exemption in F.S. 553.79 isn't automatic, either. The owner or contractor has to send the building department a written request with the contract. Electrical, plumbing, structural, mechanical and gas work are excluded, a job can't be split to get under the line, and the exemption doesn't apply at all when any part of the property is in a flood hazard area. In a 65-point grid across Cypress Gardens, 57 points fell on land, and FEMA's flood map put 21.1% of those in Zone AE and 1.8% in Zone A. Separate from the permit, Florida's lien law applies to improvements over $2,500, and the Notice of Commencement is recorded and posted before the first inspection. When the direct contract is over $5,000, the building department needs a copy before that inspection. Our Polk County permits guide lays the county and city rules side by side.
